Frequently Asked Questions - Post-judgement |
|
These are new FAQ's posted on 28th October 2005 following judgement. Earlier FAQ's are now on the Archive page. FAQ 7 updated 17th January 2006 1. Why didn't you Appeal? We read the judgement carefully, and took advice from our legal team. Although we were unhappy with some parts of the judgement, the Committee was unanimous in agreeing there were insufficient grounds for Appeal. 2. What will happen to RPSAG now? RPSAG is now disbanding. We are settling our bills and closing down our membership services operation. We will be writing out to all our members in November 2005. We will be producing final audited accounts.
3. How much money did RPSAG raise? In our main fundraising campaign in late 2002/early 2003 we raised over £2.4 million, and in total we raised over £3 million. The total sum raised was sufficient to fund the Hearing, including our own costs and those of the Government. The Government's costs were subject to a "cost-capping" agreement set at £2.03 million. There may be a small residual sum remaining after we have settled our bills, but not enough to divide and distribute back to our 50,000 members. If this is the case, we intend to donate the residual amount to a railway charity. 4. You raised a lot of money. Who is looking after it? All contributions were paid into RPSAG's bank account, with an audit trail. Funds were then transferred by RPSAG into a special client account with Edwin Coe solicitors.
The Committee has appointed external auditors to ensure that its systems and procedures are robust, and that the funds raised from members and contributors to the Legal Action Fund are properly accounted for. The external auditors are:
The Greene
Partnership Durkan House URL: www.greenepart.co.uk
Final audited accounts will be produced in due course and will be available for inspection by our members, by arrangement, at our solicitors Edwin Coe. 5. Who are your professional partners and subcontractors? Our partners and subcontractors, whose support and professional input we acknowledge, are:
Legal adviser: Edwin Coe Solicitors www.edwincoe.com
Media relations adviser: Bell Pottinger www.bell-pottinger.co.uk
Membership database manager and response handling manager: Bureau Solutions Ltd www.dbsdata.co.uk
External auditor: The Greene Partnership - Accountants & Business Advisers www.greenepart.co.uk
Credit Card payment acceptance: Worldpay www.worldpay.co.uk
This website's Worldpay interface: JK Internet www.j-k.co.uk
This website's design and maintenance: SiteSpider www.sitespider.co.uk
6. What should I do if I change my name and/or address, or obtain an email address which you can use instead of hard-mailing me? Please advise us by email on emails@rpsag.org.uk, quoting your membership number and old address with postcode. We are aware that some people have had problems using this address, so please try webmaster@rpsag.org.uk if the first address fails. We would prefer that you use email as it cheaper for us to process, but if you wish to write, please address your letter to: RPSAG, c/o Bureau Solutions, 1 Buckingham Court, Dairy Road, Chelmsford, Essex, CM2 6XW.
Please do this as soon a possible, as we will be sending out our final letter to our members in November 2005.
7. Why haven't I received what I think I'm owed from the liquidators? (amended 17th January 2006) The fourth payment by the liquidators of 8.5p per share was distributed to former shareholders in Railtrack Group plc (ie those who held shares on 30th December 2002) at the end of December 2005. There will be further payments to come in due course, so it is important you keep Computershare advised of any change of address.
The address for Computershare is The Pavilions, Bridgwater Road, Bristol BS99 7NH. Telephone 0870 702 0104. URL www.computershare.com
RPSAG and the liquidators are of course entirely separate from and independent of each other, and RPSAG cannot give any information about the liquidation process other than that on this website. If you have any questions about the liquidation process, or do not receive the third payment you were expecting, please contact the liquidators' helpline (ie Computershare) on 0870 702 0104, and not RPSAG.
